This Privacy Policy hereby incorporates by reference all terms, conditions rules, policies and guidelines on the Site, including the Adaptive Terms of Use ("Terms of Use"). Capitalized terms not defined in this Privacy Policy are defined in the Terms of Use. This Privacy Policy is effective as of August 31, 2013. Your use or continued use of the Site after such time will signify your acceptance of this Privacy Policy. We reserve the right to modify the provisions in this Privacy Policy without prior notice to you, so please check back often for updates.

Adaptive Professional Solutions LLC ("Adaptive", “the Company”, "us" or "we") respects the privacy of the visitors to its Web site, the home page of which is located at ("Site"). This Privacy Policy is intended to inform you of our policies and practices regarding the collection, use and disclosure of Personal Information and Non Personal Information you submit to us through our Site.

This Privacy Policy applies only to individuals; it does not apply to any information about companies or organizations that use the Site Services.

By submitting Personal Information through the Site, you agree to the terms of this Privacy Policy and you expressly consent to the processing of your Personal Information according to this Privacy Policy. Your Personal Information may be processed by Adaptive in the country where it was collected, as well as other countries (including the United States) where laws regarding processing of Personal Information may be less stringent than the laws in your country.

By using the Site and/or the Services, you consent to our collection, storage, use and disclosure of your personal information and other information as described in this Privacy Policy.

“Personal Information” is information that can be used to contact or identify you, such as your full name and email address, and information that is linked to such information.

"Non Personal Information" is information that cannot be used to contact or identify you and is not linked to information that can be used to contact or identify you and includes passively collected information about your activities on our Site, such as usage data, to the extent that information is not linked to your Personal Information.

“Site Visitors” are visitors who access and browse the Site without registering.

“Registered Users” are users who register with the Site.

1. Information We Collect

We collect both Personal Information and Non Personal Information about our users.

Site Visitors can access and browse certain portions of the Site without disclosing Personal Information, although, like most websites, we passively collect certain information from your computer, such as your IP address and web browser user agent, when you browse the Site. In order to utilize some of the Services offered you must register with the Site.

Information you provide

Regardless of whether you are a Site Visitor or a Registered User, all Personal Information that you provide to us when registering, posting a job, posting a profile, communicating through the Site, or that you otherwise provide on the Site, will be stored by us. You represent and warrant to us that you have the right and authority to provide us all Personal Information you provide about yourself or others. You may provide us this Personal Information in various ways, including:

1.  When registering

When you register directly through the Site, we will collect and store the information that you provide to us directly on our online registration forms. This may include, among other information:

- your first and last name

- your email address

- your home address

- your phone number

If you register for a Service that requires you to pay a fee, Adaptive will also collect your credit card type, number, expiration date, and security code as well as your billing address for payment purposes and your birthday, if not previously provided.

2.  When posting a job

If you are a Client, we collect and store all of the additional information that you provide to us on your job posting. This may include, among other information:

- the type of services you are looking for, the dates of service, location, hourly rate, your Company’s name, address, size and industry, narrative job description, and skill sets and other requirements for an Adaptive Professional

- your Company’s logo or picture you choose to provide

- any other information you choose to include in your job posting

3.  When posting a profile

If you are an Adaptive Professional, we collect and store all of the additional information that you provide to us in your profile. This may include, among other information:

- Your level of education, your professional certifications, previous work/employment history, skill sets, your availability, your desired hourly rate, and personal interests

- related services you provide

- pictures and videos you choose to post

- your phone numbers

- any other information you choose to include in your profile

4.  Otherwise through the Site

Certain Registered Users may provide Personal Information on the Site through other Site features and offerings such as our online communications, third party references, groups, payment platforms, background check process and I-9 Form.

Information provided by others

1.  By Site Visitors, Registered Users and others

Adaptive also captures and collects information that Site Visitors, Registered Users and others provide about each other.  For instance, Clients may post ratings and reviews about individual Adaptive Professionals after they have completed a job for the Client.  Additionally, when Clients request references for Adaptive Professionals, and Adaptive Professionals then request that their contacts provide a reference, Adaptive may obtain and post these text references, which may also be accessed from the Site. In addition, certain Registered Users may communicate directly with each other through Adaptive platforms.  Adaptive captures and stores all information it receives from Site Visitors, Registered Users and others about other Registered Users and Site Visitors.

2.  By third parties that perform background checks

For the legitimate business purpose of protecting the safety and integrity of the Site, the Services and Adaptive users, visitors who wish to register as Adaptive Professionals authorize Adaptive in its Terms of Use to utilize a third party consumer reporting agency to use your Personal Information to run periodic background checks on you when you register with Adaptive and thereafter in connection with your continued use of our Services and/or interaction with our Site. Any such background checks will be subject to the terms we establish for such checks on the Site pages where you may request them, the terms of this Privacy Policy and our Terms of Use.  Adaptive, and the Adaptive Professional who is the subject of the background check, each receive a copy of such completed background check.  Completed background checks are not provided by Adaptive to any other party.

3.  By service providers you use in connection with our Services

If you engage a service provider through Adaptive, such as a skill test provider or a payments processor, that service provider may provide us Personal Information about you such as information relating to your transactions with them.

4.  By other sources

In addition, we may obtain from other sources publicly available Personal Information, such as demographic data, and other information to enable us to comply with regulatory requirements, ensure the accuracy of data, better understand your likely interests, prevent fraud, etc.

Team Accounts

If you are a Registered User of a Team Account, the information you provide to the Site may be accessible to other Registered Users of the account under which your Team Account was added.

Technical and usage information


1.  Log files, IP addresses and information about your computer and mobile device

When you visit the Site, Adaptive receives the internet protocol ("IP") address of your computer (or the proxy server you use to access the internet), your computer operating system and type of web browser you are using. If you are using a mobile device, Adaptive may also receive your mobile device id (UDID), or another unique identifier, and mobile operating system. We may correlate this information with other Personal Information we have about you. Additionally, when you visit the Site we and any third parties we use to place ads on our Site automatically receive the URL of the webpage from which you came. If you click on an ad, we and any such third party may also receive the URL of the page you were on when you clicked the ad and the URL of the site associated with the ad that you clicked.

2.  Cookies

When you use the Site, Adaptive or our contractors may place small data files called cookies on your computer. Adaptive uses cookies to enable users to specify unique preferences and to track your use of the site, including trends and patterns. Adaptive sends a session cookie to your computer when you log in to your account. This type of cookie helps if you visit multiple pages on the Site during the same session, so that you don't need to enter your password on each page. Once you log out or close your browser, this cookie expires. Registered Users and Site Visitors always have the option of disabling cookies via their browser preferences. If you disable cookies on your browser, please note that some parts of our Site may not function as effectively or may be considerably slower.

3.  Social media features and widgets

Our Site includes social media features and widgets such as the Facebook “Share” button. These features may collect your IP address, the URL of the page you are visiting on our Site, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these features are governed by the privacy policy of the company providing it.

2.  How We Use and Share Information

Personal Information

We use Personal Information for our own internal purposes including contacting you via email to inform you about updates to Site Services and providing you with information relating to e-commerce transactions that you conduct on the Site. We reserve the right to disclose your information as required by law. We do not rent or sell our users' Personal Information to third parties.


We may send you email communications including information that we think may be of interest to you. You may opt out of receiving these email communications by sending an email to We do not send any of your Personal Information to our advertisers.

Adaptive’s Contractors and Partners

To the extent necessary to provide you with the services on the Site, we may provide your Personal Information to third party contractors and/or partners who work on behalf of or with Adaptive to provide you with such services, to help us communicate with you or to maintain the Site.

Other Members

Members may request full contact information of another member, including name, company name, email address, phone number and mailing address. You agree not to use the disclosed information of other users for any purpose other than providing the applicable services or resolving a dispute.

Social Media Widgets

Our Site includes social media features and widgets, such as the Facebook “Share” button. These features may collect your IP address, which page you are visiting on our site, and may set cookies to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these features are governed by the privacy policy of the company providing it.

Background Checks

If you have requested a background check through the Site, a statement may be included in your profile to confirm that you have completed that check. However, we will not share the check or results with any other Site Visitor or Registered User. The service provider who completes the background check may send the results to you by email or postal mail. You acknowledge that sensitive material may be included in your background check, and that you are responsible for providing us and our service provider (if applicable) with correct mailing information.

Legal Requests

You acknowledge and agree that we may disclose information we've collected about you if required to do so by law or if we, in our sole discretion, believe that disclosure is reasonable to comply with the law, requests or orders from law enforcement, or any legal process (whether or not such disclosure is required by applicable law), or to protect or defend Adaptive's, or a third party's, rights or property. We may also reserve the right to disclose information we've collected about you for purposes of protecting the health and safety of our community and Registered Users, such as in the case of risk of harm or violence against any person (including you).


Although we currently do not have a parent company, any subsidiaries, joint ventures or other companies under a common control (collectively, "Affiliates"), we may in the future. We may share some or all of your Personal Information with these Affiliates, in which case we will require our Affiliates to honor this Privacy Policy.

Business Transaction

If our company or our assets related to the Site are acquired by another company, we will attempt to notify you so that you may make an informed decision about this new use of your Personal Information.

Non Personal Information

This Privacy Policy does not limit our use or disclosure of any Non Personal Information, such as information passively collected from your computer via cookies, web beacons, or standard logging of website activity. If you do not wish to share this information with Adaptive, then you should take steps to limit the passive collection of data about your activities on our site, for example, by changing your browser settings to disable cookies. We reserve the right to use and disclose such Non Personal Information, as well as any other Non Personal Information we collect, with our advertisers and other third parties at our discretion.


We will use commercially reasonable methods to keep Personal Information securely in our files and systems. Our Payment System is operated using secure Internet connections, using SSL (Secure Sockets Layer) encryption, to help protect your financial data. Please note that with current technology, we cannot guarantee the security of your data as it travels over the Internet.

Data Retention

We will retain your information for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that we no longer use your information to provide you services contact us at We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Collection of Information from Children

Adaptive’s Site and Services are not intended for individuals under the age of 18. Accordingly, Adaptive does not knowingly collect, either online or offline, personal information from individuals under the age of 18.

Terminating Your Membership

To close your account, contact us at If you close your account, we will remove your name and other Personal Information from our publicly viewable database. If you close your account, we have no obligation to retain your information, and may delete any or all of your account information without liability. However, we may retain information related to you if we believe it may be necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, Non Personal Information, account recovery, auditing our records, enforcing our rights and obligations under our agreements or if required by law. We may also retain and use your information if necessary to provide the Services to other Registered Users. For example, messages you send through the Site to other Users, as well as your contributions to the Site’s groups, may remain visible to others after you have closed your account. Similarly, other information you have shared with others, or that others have copied, may also remain visible. Adaptive disclaims any liability in relation to the deletion or retention (subject to the terms herein) of information or any obligation not to delete the information. Adaptive does not control when search engines update their search index or cache, which may contain certain job post, profile or other information that has since been removed from the Site.

Correcting/Updating Your Information and Opting Out

The Site gives several options for changing and modifying information previously provided.

1.  The following options are accessible under My Account in the navigation bar after you login:

a.  Clients may update their profile information using the Manage Profile page. Adaptive Professionals may update their profile information using the View/Manage Profile section.

b.  Clients may opt-out of receiving network invitations, email communications related to activities associated with jobs they have posted, and group activities, by using the Settings page.

c.  Adaptive Professionals may opt-out of receiving email communications related to activities associated with jobs they have applied to or been invited to, and group activities, by using the Email Preferences page.

d.  Candidates can adjust who may see their profile, send them contact messages, and send them network invitations by using the Privacy Settings page.

2.  You may update your credit card or other payment method information using the Payment Method page, under Manage Financial Accounts in the navigation bar after you login.

3.  Registered Users may opt-out of receiving promotional email communications from us by emailing  However, you may not opt out of receiving administrative communications from Adaptive regarding the Site Services or the Site, except by terminating your membership. In addition, you may not opt out of Adaptive sending you legal notices related to Site Services or the Site.

3. The Job Page

The Job Page is for the benefit of Registered Users. The Job Page facilitates communication and the exchange and sharing of information between Clients and Adaptive Professionals once an Adaptive Professional has applied to a job or been invited to the job by the Client. The information contained in the Job Page is shared between Clients and Adaptive Professionals and is not used for any purposes other than to facilitate communication and the exchange of information between the parties involved. Adaptive reserves the right to monitor communications in the Job Page in order to verify compliance with our Terms of Use, international, federal or state laws and/or our other stated policies.
